RE Hawkwind trademark hearing....

We are really happy to let everyone know, that a decision has finally been reached in the USA by the TTAB regarding HAWKWIND and Nicholas Turner.
The Trademark Trial and Appeal Board found in Hawkwind's favour and has just issued an order which sustained our opposition.

Nik Turner CANNOT use the name Hawkwind!
Its been over three hard years, which has drained our energies and resources......We are so glad its over and the correct verdict has finally been reached.

The members of Hawkwind would like to thank you all for your support in what has been a very stressful few years! Hopefully we can now put all this behind us and get on with other more creative and positive stuff!

We will comment further when the news has finally sunk in.....But for now, we are off to celebrate! Please raise a glass, (or whatever), to the good ship Hawkwind!

A conclusive judgement that, worth reading in full. What Turner's lawyers thought they were doing saying there's no possibility of confusion over the name when there are precedents undermining their case so it was pretty much doomed from the start, who knows.

I just hope their lawyers cost Turnip and Cleo lots of cash which they won't be getting back. Picking long legal fights you are unlikely to win against an opponent who won't just fold and give up before it gets to court is not a good or cheap idea.

And with any luck, that's the end of that and the last we'll hear of "Nik Turner's not-really-Hawkwind-at-all".

Recognition to the trench warfare that took place during renruT's last tour.
There were thousand's of e-mails sent out to promoters in the U.S.
making them aware of the HAWKWIND rip-off attempt.

The TTAB (trademark board) judgement is 22 pages long but my impression is that basically Dave Brock drew 0-0 on a couple of legal points and won around 8-0 on all the other ones. In short, a resounding vindication.

I don't want to sound triumphalistic here, but I'd say that Dave has overwhelmingly proved his point.
