I only hope this impacts negatively on Cleporaptor's ability to squeeze money out of groups by backing fringe former members.

I notice on Turnips faeces book folks are claiming he/cleo are going to appeal - WTF? This cannot be true!? And I cannot believe there are SO MANY IGNORANT DELUDED people out there STILL supporting him FFS!

The decision is unanimous enough to be deemed un-appealable (?).

You guys are right, I suspect its just wishful thinking that they can appeal the appeal of the appeal...
The whole thing just pisses me off, and I'm sick and tired of people stating he has some sort of "claim"

I've had a look at the TTAB rules - light reading they ain't - and from what I can make out they could try to appeal the judgement. Hell, they could try to keep appealing all the way to the US Supreme Court if they put their minds to it.

Whether there'd be any point in appealing is what matters. If Cleo lost an appeal it might tighten the law up against them and make it more difficult for them to try the same stunt on someone else. And appeals aren't cheap things, lawyers who handle them are usually specialist experts at the top of the tree and charge even more than the usual US civil lawyers do.

An appeal usually has to be asked for within 60 days of the judgement appealed against, though there seem to be some exceptions to that in special circumstances, and several ways to go about it. But overall I guess they'll have to put up or shut up pretty soon.

It's really sad that things have come to this. An old man who can't let go of something he was last part of 30 years ago and doesn't even seem to have been happy a lot of the time when he was part of it. And what's stopped him going his own way, putting together his own vision, assembling a band capable of interpreting and expanding that vision and making a success of it like Dave has with Hawkwind?

Whatever the reason, it ain't because he can't call himself Hawkwind.

My impression was, after reading the 22-page PDF document, that Dave Brock won almost every round. OK, let's compare it to a boxing match. There was only one round where it was judged to be 50-50 and that was the "bad faith" element. All other aspects went Brock's way - sometimes just convincingly, and sometimes totally overwhelmingly.

Any record company that wants to mount an objection against an avalanche, step forward now.
